ANALISIS KEBIJAKAN DALAM PERUNDANG-UNDANGAN
Abstract
Legislation is an essential instrument in state governance as it provides the legal foundation for public policy and serves as a guideline for society. However, in practice, numerous issues remain, including weak effectiveness, overlapping regulations, and a lack of relevance to societal needs. This study aims to analyze the role of policy analysis in legislation with a focus on effectiveness, synchronization, and relevance of regulations to public needs, while also identifying weaknesses in the current practice of policy analysis and proposing an alternative framework that is more integrative, evidence-based, and participatory. This research employs a library study method by examining academic literature, official documents, previous studies, and relevant legal products, analyzed through a descriptive-analytical approach and content analysis. The findings reveal that the effectiveness of policy analysis remains weak due to the lack of evidence-based studies and systematic regulatory evaluation; synchronization of regulations is still problematic because of overlapping rules and weak intersectoral coordination; and the relevance of regulations is limited since the legislative process tends to be top-down and insufficiently participatory. The study concludes that the quality of regulations in Indonesia does not yet fully reflect the principles of good governance, thus requiring the strengthening of evidence-based policy analysis instruments, systematic regulatory harmonization, and broader public participation to ensure that legislation is responsive and equitable.
