TINJAUAN HUKUM ISLAM TENTANG PRAKTEKTUAL BELI GETAH KARET DENGAN PENAMBAHAN PARTIKEL

Abstrak

Buying and selling is a transaction carried out by both parties, namely the seller and the buyer in the case of transferring ownership rights to an object which is preceded by a contract and handing over a predetermined amount of money. In buying and selling rubber latex, fraud often occurs among rubber farmers who sell their rubber latex to middlemen. Deviations or fraud committed by rubber farmers to manipulate the weight of rubber scales filled with particles such as: sand, sawdust and others. So the weight of the rubber increases while the middleman suffers a loss. In Islamic law it is strictly prohibited to increase the weight of the rubber by cheating. The aim of this research is to determine the practice of buying and selling with the addition of particles. To find out an overview of Islamic law regarding the practice of buying and selling rubber latex with the addition of particles. This research method is field research, and the nature of the research is qualitative descriptive. The data collection is by using interviews and observations. Based on the research results, it can be concluded that the practice of buying and selling rubber latex is by adding particles to the latex, that is, when the rubber has been tapped by the farmer, then the chips/wood dust is put into a bowl, then the rubber latex that has frozen on the ground is mixed with the sand that did not enter the bowl. and mixed into a bowl with new sap. This practice has become a community habit. Buying and selling rubber latex with the addition of particles in Islamic law is invalid because it is not in accordance with Islamic law, because it contains elements of gharar, there is an unclear quality and quantity of rubber being traded, so there is an element of fraud.
