The Compilation of Islamic Law Article 97 KHI regulates widows or widowers divorced each entitled to one-second of the common property as long as it is not specified otherwise in the marriage agreement. Background in this study there is a lawsuit between the ex-wife of Alm Herman Bin Abdul Kadir, Defendant I is the first child of the Plaintiff and Alm Herman Bin Abdul Kadir and Defendant II is the new wife of Alm Herman Bin Abdul Kadir This research uses a kualitataif approach with this type of literature research. Recently, we revealed of this study is to analyze the results of the Religious Court's Ruling on Joint Property Lawsuits Number: 0570 / Pdt.G / 2021 / PA.Mt. The results of the study showed that based on Article 1 letter (f) of Presidential Decree No. 1 of 1991 on compilation of Islamic Law. So in the verdict Number: 0570 / Pdt.G / 2021 / PA. Mt is the plaintiff's indible lawsuit (niet ontvankelijke verklaard) and plaintiff to pay the costs of the case amounting to Rp. 715,000.
