Analisis Pengangkatan Anak Adopsi Dalam Tinjauan Hukum Positif dan Hukum Islam

Penelitian ini bertujuan untuk mengetahui praktik
pengangkatan anak serta tinjauan hukum Islam dan hukum positif
tentang pengangkatan anak dalam masyarakat. Penelitian ini
menggunakan metode “library research” dan “field research” telaah
dokumen, observasi dan wawancara. Hasil penelitian menunjukkan
bahwa mekanisme pelaksanaan pengangkatan anak dikalangan
masyarakat, tahapan yang dilakukan masyarakat tidak ada suatu acara
kusus atau ritual lainya dalam proses pengangkatan anak, akan tetapi
hanya dengan melakukan kenduri kecil-kecilan, dan alasan
pengangkatan anak karena keluarga yang melakukan pengangkatan
anak lebih cendrung karna belum punya keturunan sendiri. Lalu
disarankan kepada setiap orang tua angkat agar mencari tau
bagaimana tata cara pengangkatan anak yang benar menurut agama
dan peraturan perundang-undangan negara, dan kepada tokoh agama
dan tokoh masyarakatsupayadapat mensosialisasikan mengenai tata
cara pengangkatan anak yang sesuai dengan ajaran Islam dan
peraturan yang berlaku mengenai pengangkatan anak, agar tidak
menimbulkan permasalahan dikemudian hari.

Penelitian ini adalah bagaimana implikasi wanita karir
bagi keharmonisan rumah tangga di Desa Pugung raharjo
Kecamatan Pugung raharjo Pagar Lampung timur? bagaimana
pandangan hukum Islam terhadap wanita karir? Penelitian ini
bertujuan untuk mengetahui pengaruh wanita karir bagi kehidupan
atau keharmonisan rumah taangga di Desa Pugung Rahajo Kec
Sekampung Udik Ka Lampug timurdan mengetahui Pandangan
Hukum Islam Terhdap Wanita Karir. Jenis penelitian ini adalah
(field research). Dalam hal ini, data maupun informasi bersumber
dari Wanita-wanita Karir di Desa Pugung raharjo Kecamatan ugung
raharjo Pagar Lampung timur. Metode pengumpulan data yang
digunakan adalah wawancara dan dokumentasi. Penelitian ini
penelitian lapangan (field research) bersifat kualitatif analisis
dengan pendekatan berfikir induktif. Hasil penelitian bahwa
implikasi wanita karir di desa Pugung Rahajo Kec Sekampung Udik
Ka Lampug timurdapat berpengaruh positif dan negatif.
Berpengaruh positif selama para istri berkarir dengan mengikuti
ketentuan dan syariat agama serta dapat membagi waktu untuk
keluarga, tentu akan mendatangkan keuntungan baginya yaitu
keharmonisan dalam rumah tangga.

Akhir-akhir ini masalah lesbianisme telah menarik
perhatian masyarakat luas, baik dari kalangan media, tokoh agama,
akademisi, dan bahkan menjadi topik hangat dalam kampanye politik
Obama, bahkan mengenai lesbianisme kemudian dikaji secara
intensif dalam diskusi dan forum-forum akademik, terkait dengan
adanya Rancangan Undang-Undang Keadilan dan Kesetaraan Gender
(RUU KG) serta kedatangan tokoh Lesbi Kanada ke Indonesia.
Persoalan ini tentunya harus dilihat dari perspektif hukum Islam,
bukan pandangan sekularisme atau humanisme, karena hukum Islam
adalah pedoman yang sesuai dengan fitrah manusia. Sekularisme dan
humanisme hanya menilai persoalan secara parsial, bahkan
menyesuaikan diri dengan nafsu manusia. Sedangkan jiwa manusia
akan terus menuruti hawa nafsu jika tidak dibimbing oleh wahyu atau
aturan Allah. Hukum Islam ditegakkan dalam rangka mengendalikan
hawa nafsu, agar manusia tetap pada fitrahnya. Metode penelitian
dalam kajian ini menggunakan metode yuridis normatif. Penggunaan
ini dilakukan karena alasan bahwa fokus penelitian ini menekankan
pada data sekunder dengan mempelajari dan mengkaji azas-azas,
bahan-bahan dan kaidah-kaidah hukum positifnya berdasarkan
bahan-bahan kepustakaan yang ada dalam perundangundangan
Hukum Perkawinan dan Undang-Undang Hak Asasi Manusia (HAM)
Indonesia.

Regarding the implementation of marriage among
Muslims, since the beginning of independence, the
government has taken an active role by establishing
provisions on marriage, namely in laws and regulations.
This policy is taken as an effort by the government to

family life, including the legal consequences arising from

Pengangkatan anak di Indonesia telah menjadi kebudayaan
masyarakat dan menjadi bagian dari sistem hukum kekeluargaan,
karena menyangkut kepentingan orang perorang dalam keluarga.
Oleh karena itu, lembaga pengangkatan anak (adopsi) yang telah
menjadi bagian budaya masyarakat, akan mengikuti perkembangan
situasi dan kondisi seiring dengan tingkat kecerdasan serta
perkembangan masyarakat itu sendiri. Pada prinsipnya pengangkatan
anak (adopsi) adalah perbuatan hukum dengan cara mengambil anak
orang lain yang bukan keturunannya untuk dipelihara dan
diperlakukan sebagai anak keturunan sendiri. Faktor lain dari tabanni
terkadang karena keinginan mereka untuk meringankan beban orang
tua kandung anak angkatnya yang serba minim, baik karena hidup
pas-pasan atau karena mempunyai anak yang banyak. Prosedur tabani
menurut fikih Islam yaitu dengan cara tidak menasabkan status
hukum keperdataan anak dengan orang tua yang mengangkatnya dan
tidak ada prosedur khusus dalam proses tabanni. Sedangkan prosedur
tabani menurut Undang-Undang No. 23 Tahun 2002 harus dilakukan
yang pertama dengan mengajukan permohonan, kedua proses
persidangan di Pengadilan dan ketiga, penetapan Pengadilan.

Tujuan dari penelitian ini adalah untuk
mengetahuipengaruh hak dan kewajiban serta keharmonisan rumah
tangga pada perkawinan yang tidak bertanggung jawab. Untuk
menganalisis tinjauan hukum Islam terhadap perkawinan yang tidak
bertanggung jawab serta pengaruhnya pada keharmonisan rumah
tangga. Jenis penelitian dalam skripsi ini adalah bersifat penelitian
lapangan (field research). Data primer dikumpulkan melalui
observasi dan wawancara, dan dilengkapi oleh data sekunder.
Analisis dilakukan secara kualitatif dengan metode berfikir induktif
yaitu berasal dari fakta-fakta yang khusus peristiwa kongkrit yang
ditarik generalisasi secara umum. Berdasarkan hasil penelitian dapat
disimpulkan bahwa perkawinan yang tidak bertanggung jawab di
Desa Gunung Mulyo Kec. Sekampung Udik Kab. Lampung Timur
dalam kenyataannya konflik dan kesalah pahaman diantara mereka
kerap kali terjadi sehingga melunturkan semua yang diharapkan,
hukum perkawinan yang tidak bertanggung jawab antara pasangan
suami isstri yang sah apabila melalaikan tanggung jawabnya maka
hukumnya berdosa, karena Allah Swt telah menetapkan hukuman
atau sanksi pedih bagi perempuan dan laki-laki yang melalaikan
tanggung jawabnya.

menetapkan hukuman atau sanksi pedih bagi perempuan dan lakilaki yang melalaikan tanggung jawabnya .Jika memenuhi rukun

Ogan Komering Ilir dalam mengadopsi anak dalam kandungan tidak
melalui proses-proses yang ada pada hukum Islam dan hukum
Positif, adopsi anak ini hanya berdasarkan hukum adat dan kebiasaan.

kandungan itu, anak yang diadopsi tersebut dijadikan sebagaimana

kedua orangtua angkatnya jatuh kepada anak angkat, karena menurut
orangtua angkat, anak angkat itulah yang berhak atas semua harta
warisan yang dimiliki oleh kedua orangtua angkatnya

Anak merupakan anugerah dan amanah yang diberikan
Allah swt kepada orangtua. Orangtua yang telah diberikan anugerah
dan amanah tersebut tentu memiliki hak dan kewajiban timbal balik,

hal, baik pemeliharaan, pendidikan, perlindungan maupun masa
depan- nya. Dalam hukum Islam tidak ada larangan untuk melakukan
pengangkatan anak asalkan kedudukan anak angkat itu tidak
disamakan dengan kedudukan anak kandung. Menurut hukum islam
anak agkat tidak diakui untuk dijadikan sebagai dasar dan sebab
mawaris, karena prinsip pokok dalam kewarisan hukum islam adalah
hubungan darah atau arhaam. Berangkat dari hal tersebut, maka
penulis akan menelusuri Bagaimana pengangkatan menurut hukum
islam. Penelitian ini menggunakan metode kualitatif bertujuan untuk
memahami keadaan atau fenomena tentang apa yang dialami subyek
dalam perilaku, persepsi, motivasi, tindakan dengan cara
mendiskripsikan dalam bentuk kata-kata dan bahasa, pada suatu
konten khusus alamiah dengan memanfaatkan berbagai metode
ilmiah. Dalam metode kualitatif yang biasa digunakan adalah
wawancara, pengamatan, dan Studi Kepustakaan. Studi pustaka disni
dilakukan dengan maksud memperoleh data sekunder yaitu melalui
serangkaian kegiatan mencatat, mengutip, menelaah, serta membaca
buku atau literatur-literatur yang berkenaan dengan masalah
pengangkatan anak.

they can adopt a child so as to take a child from someone
else's child by caring for, raising and covering all the needs
of the child to include his daily needs and education costs.
Islamic law also allows this to be done but does not sever
the child's relationship with his biological parents.
However, in this case, the people of Sumber Makmur
Village, Ogan Komering Ilir, carry out child adoption not
in the way described in Islamic law but in their own way
as well as severing the relationship between the adopted
child and his biological parents. This is certainly very
contrary to the conditions of child adoption in Islamic law.
This is the problem that will be studied in this study. The
objectives of this study are: (1) To find out how the process
of removing children in the womb in the community of
Sumber Makmur village, Lempuing Ogan Komering Ilir
District. (2) To determine whether the process of adopting
a child who is still in the womb is in accordance with
Islamic law and positive law.This research is a type of field
research (filed research). This research is descriptive
analysis, namely research that aims to describe and analyze
the subject under study, using a normative juridical
approach, namely an approach that leads to and leads to the
problem of establishing a based on the texts of the Qur'an

position. But what happens to rural communities is that
there are several reasons that make these marriages not
recorded because of the lack of public knowledge about the
importance of marriage registration and the distance
traveled from the countryside is too far to reach the district,
making people reluctant to record their marriages.
Therefore, in this case, penghulu has an important role in
the marriage registration.The problem in this study is how
the role of the penghulu on marriage registration in the
KUA of Abung Semuli District, North Lampung. The
purpose of this study is to determine the role of the bride
and groom clerk regarding the administrative services
carried out by KUA more optimally. As well as knowing
more about the role of the penghulu in the registration of
marriages.This research is descriptive, which is a study
that aims to describe the situation or object in actual facts,
systematically and the characteristics of the subject and
object are studied accurately, so that a clear picture is
obtained. Based on the results of the findings, it shows that
the role of penghulu is not optimal in carrying out marriage
registration, because there are inhibiting factors, especially
in terms of infrastructure so that they cannot reach villages

marriages in building a household. The purpose of this
study is to determine the influence of rights and obligations
and household harmony on irresponsible marriages. To
analyze the Islamic Law review of irresponsible marriages
and their effect on domestic harmony.The type of research
in this thesis is field research. Primary data are collected
through observation and interviews, and supplemented by
secondary data. The analysis is carried out qualitatively
with an inductive thinking method, which is derived from
facts that are specific concrete events that are drawn
generalizations in general
Based on the results of the study, it can be concluded that
irresponsible marriages in reality conflicts and
misunderstandings between them often occur so as to
soften all that is expected, the law of irresponsible
marriage between legal married couples if they neglect
their responsibilities then the law is sinful, because Allah
Swt has set painful penalties or sanctions for women and
men who shirk their responsibilities

Adoption was originally the adoption of the child
which resulted in the removal of the adopted child from the
father's own nasab relationship and entry into the adoptive
father's nasab relationship. In practice adoption is usually
carried out people who in their mating do not produce
offspring. With the path of adoption the adoptive child has
a relationship with the adoptive father as with the
biological father himself. There is an inherited relationship
between the adopted son and the adoptive father. Before
Islam came, the adoption of children had been carried out
by the Arabs and had become a hereditary tradition known
as tabanni which means taking children. Or take someone
else's child to be given the status of a biological child, so
that he has the right to use the nasab of his adoptive parents
and has the right to inherit inherited property and other
rights as the child's relationship with the parents. In Islam
adoption is indeed allowed and is one of the noble deeds,
because it helps underprivileged families to raise their
children. However, adoption by eliminating the nasab is
prohibited in Islam because this deed is the same as that
done by the jahiliyah community at the beginning of Islam.

Sex deviance develops over time, so that sex
becomes a "dirty" and "disgusting" word, whereas in
Quraish Shihab's view that sex in the Islamic view is
something holy. Sex is a fundamental difference related to
reproduction, in one type, which divides this breed into two
parts, male and female according to the sperm (male) and
egg (female) produced. The problem arises if then there is
sexual deviance, namely similar relationships that occur
among the community, including one of them in Sukabumi
Village, Bandar Lampung City.The formulation of the
problem in this study is: How is the relationship similar
according to the views of community leaders in Sukabumi
village, Bandar Lampung City, viewed from the
perspective of Islamic law? and what are the factors
causing the emergence of public figures' views on similar
relationships in Sukabumi village, Bandar Lampung City
This study aims to determine similar relationships
according to the views of community leaders in Sukabumi
village, Bandar Lampung City, from the perspective of
Islamic law and to find out the factors causing the
emergence of community leaders' views on similar
relationships in Sukabumi village, Bandar Lampung City.
This research is included in field research, according to its
nature this research is descriptive. The data collection
methods used are interviews, observations and
documentation. The results showed that, community
leaders viewed the existence of same-sex enthusiasts as
damaging the joints of people's lives should have received
stricter action because it was feared that it could be
transmitted to the younger generation in Sukabumi
Village, this was due to same-sex behavior contrary to religious norms and violations of humanitarian law. The
perpetrator is declared to be a person who deviates from
reasonableness and needs to be treated seriously so as not
to cause troubling social ills.

Poligami sirri adalah perkawinan seorang laki-laki
dengan lebih dari seorang perempuan dalam waktu bersamaan yang
perkawinannya tidak dicatat di KUA, zaman sekarang ini marak
terjadi poligami sirri,disebabkan mereka tidak mau mentaati
peraturan yang berlaku saat ini dengan alasan ribet dengan syarat
dan prosedur yang telah ditetapkan oleh pemerintah sehingga lebih
memilih poligami sirri yang prosesnya cepat, mudah, tidak
repot dan tidak memakan banyak waktu. Disamping itu banyak
masyarakat Indonesia yang tidak memahami peraturan
poligami,mereka melakukan poligami sirri dengan memenuhi
syarat- syarat perkawinan yang telah ditetapkan agama Islam.
Tujuan peneliti ingin mengetahui tentang poligami sirri menurut
hukum positif, hukum Islam dan tentang hak istri dalam poligami
sirri menurut hukum poitif dan hukum Islam. Metode penelitian
yang digunakan antara lain: Metode penelitian pengumpulan data,
yang berupa Library Research, dan metode penelitian analisis data
dan laporan hasil penelitian kualitatif.
